What you need to know about Arizona abortion laws
Abortion is legal in Arizona. In November 2024, Arizona voters passed Proposition 139 (61.6% in favor), which added the right to abortion care to the state constitution. The amendment prevents the state from interfering with abortion rights before fetal viability, and limits the state’s ability to interfere with abortions to protect the life or health of the pregnant person after fetal viability.
Since then, courts have steadily struck down restrictions that conflicted with this protection. In March 2025, a state superior court blocked an attempt to restrict abortion beyond 15 weeks.
In February 2026, a state superior court permanently blocked the ban on telehealth for the abortion pill, and struck down unnecessary requirements for multiple clinic visits, in-person counseling, and ultrasound before an abortion. This opened up the door for providers like Hey Jane to expand care to Arizona.
Although abortion is legal in Arizona up to fetal viability, some barriers remain:
- Insurance restrictions: Arizona Medicaid does not cover abortion except in limited circumstances, and marketplace insurance plans face similar restrictions.
- Permission for minors: Parental notification and consent are required, though a judge may waive this requirement (judicial bypass). However, neither consent nor judicial bypass is required in certain limited circumstances involving rape, incest, or medical emergencies.
- Provider restrictions: Only licensed physicians may perform abortions in Arizona.

How late can you get an abortion in Arizona?
Abortion is legal before fetal viability, the point in pregnancy when a fetus has developed enough to survive outside the uterus without extreme medical intervention. This usually happens around 24 to 26 weeks of pregnancy, but is determined by a physician on a case-by-case basis. After viability, abortion is only allowed to protect the life or health of the pregnant person.
Who can get an abortion in Arizona?
Anyone with a uterus can get an abortion in Arizona before fetal viability (usually 24–26 weeks) as determined by a qualified provider. Residency is not required, and people from other states can travel to Arizona for care.
College students, military service members, undocumented individuals, and minors all have the right to seek abortion care within these timeframes. However, parental involvement is required for patients under 18. If a minor cannot get permission from a parent, conservator, or guardian, they can request a judicial bypass.
What types of abortion are available in Arizona?
There are two main types:
- Medication abortion (the abortion pill): Uses two medicines, mifepristone and misoprostol, to end a pregnancy. Available up to 10 weeks of pregnancy through Hey Jane's virtual care or at in-person clinics.
- Procedural abortion (in-clinic): A clinician uses gentle suction to empty the uterus in a quick 5–15 minute procedure. Available until fetal viability in Arizona, and after fetal viability if for the protection of the life and health of the pregnant person, or if the fetus will not survive.
Both methods are safe, effective, and widely used. The right option depends on how far along your pregnancy is, your health history, and your preference. Use our pregnancy calculator to find out how many weeks pregnant you are →

Beware of fake clinics in Arizona
When looking for an abortion provider, use trusted resources like INeedAnA.com or AbortionFinder.org. Fake clinics, sometimes called crisis pregnancy centers (CPCs), can look like real clinics but are not. They try to convince abortion seekers to continue their pregnancy, often using wrong information or scare tactics.
Arizona has at least 45 fake clinics, about 5 times the number of real ones. 11 of Arizona's 15 counties have a fake clinic while only 3 counties have a real one.
If you're not sure about a clinic, check exposefakeclinics.com/arizona or crisispregnancycentermap.com.
