What you need to know about Wisconsin abortion laws
Abortion is legal in Wisconsin. In 2019, the state Supreme Court ruled that the Wisconsin constitution guarantees the right to abortion, and in July 2025, the Court confirmed that a restrictive 1849 state law does not ban abortion.
Abortion is allowed before 22 weeks of pregnancy (measured as 20 weeks after fertilization), but the state still has many barriers to care. Wisconsin has some of the most burdensome medication abortion rules in the country, including:
- Delays and extra visits: Patients must attend in-person counseling and wait at least 24 hours before getting care.
- Unnecessary testing: Patients are required to get an ultrasound before an abortion, which is not medically necessary in most cases.
- Telehealth ban: Medication abortion is not allowed to be prescribed through virtual providers like the ones available through Hey Jane. This is especially burdensome given that only three cities in Wisconsin have an in-person abortion clinic.
- Permission for minors: Parental notification and consent are required, though a judge may be able to waive this requirement.
